 つぶやくの忘れてて日付が変わっちゃったけど、7月ってのは、大学紛争のせいで、ボクが就職した月だし、役所で一番よく異動させられた月でもある。
 遡れば、学生時代は夏休みが始まる月でもあった。
 そういう7月と縁がなくなって久しい。
 思えば随分ボクも春秋を重ねてきたものだ。

≫とりあえずコラム#3754を読んでみそ。有料読者になって未公開コラムを読んでれば、んな質問しないですんだのにな。≪(コラム#4871。ζβζβ)

 有料読者なので長年コラムを読んでからの質問です。

 最新コラムの一群で、コラム3754を見ろと書いてあったから読んだら、理論が欧州の研究者によって唱えられたというだけで、現実に市場原理主義を実行したのは、イギリスとアメリカだけでしょう?
 ヨーロッパ諸国は研究者を生み出しただけで、受け入れはしなかった。
 それは欧州が市場原理主義をまともなものだと思っていなかったからではないですか。
 キリスト教原理主義というのはプロテスタントのことですし、キリスト教徒が旧約聖書に回帰したらユダヤ教になりますよね?
 確かにドイツはプロテスタントを生んだ国です。
 でも今でもドイツはカトリックが多く、プロテスタントは多数派ではありません。
 ウィキペディアのドイツの項目によると両者の数は拮抗しています。

 教皇ベネディクト16世はドイツ人だし。
 フランスの方はもちろんカトリックの国です。
 フランス、スペイン、イタリアなどは、よくパターナリズムと批判されますが、パターナリズムの国は個人主義とはいえないでしょう。
 ハンナ・アーレントは、ドイツには反ユダヤ主義があったが、元々フランスにはなかったと言っています。
 フランスにはユダヤ人はあんまりいなくて、差別しようにも対象がいないというのが実情でしょう。
 フランスで要職についたユダヤ人に、レオン・ブルムがいます。
 戦後の臨時政府のほんの短い間でしたが、フランス人の間では、最初のユダヤ人の大統領と認識されています。
 戦前には首相も務めています。

 欧州は、社会を原理主義化、個人主義化させようとする動きから、必死に身を守ってきたように見えます。
 「原理主義化、個人主義化させようとする動き」というのは、イギリスやユダヤ教徒(ユダヤ教はそもそも原理主義的)からやってきているのではないでしょうか。
 イギリスのコアな部分が原理主義、個人主義なのではないですか。
 まともそうなイギリス人だと思ったら、アダム・スミスもヒュームもスコットランド人だし、バークはアイルランド人です。
 反対にベンサムみたいな極悪人はロンドン出身でした。

 こんなことをいうと太田さんの主張に真っ向から反しているのはわかっていますが、長年有料読者として読んできて、それにも関わらずいつまで経っても同じ印象を抱き続けているので、他の読者の人達はどう思うのか尋ねてみたいんです。

 勝ち誇ったように検察批判を展開している、恥ずかしーいコラムがまた出てたな。
 この筆者の発想は、憲法を「押し付けた」占領軍を擦り切れたレコードのように非難し続ける戦後日本の「右」の発想と同じだ。
 私の仮説だが、戦後、日本の刑事訴訟が、それまで欧州型の糾問主義であったところ、英米型の当事者主義の中途半端な接ぎ木的採用等を占領軍によって強いられたことから、捜査当局が捜査・取調べに困難をきたしたため、戦前からの捜査・取調べ手法中、威迫と欺罔の手法に磨きをかけた捜査・取調べ手法が特捜を中心に、検察全体、及び警察において、発達・確立して行ったということじゃないかね。
 いずれにせよ、私は、この際、刑事訴訟手続きにおいて英米型の当事者主義を徹底して、検察に、英米では常識的な、捜査・取調べのための「武器」を新たに与えなきゃならない、と思うんだ。↓
