≫日本が犯した戦争犯罪なんて、ナチスドイツどころか、米国が犯した戦争犯罪に比べてもピーナツみたいなもん≪(コラム#4553。太田)

 私はアメリカの都市空襲や原爆投下は戦争犯罪ではなくてホロコーストだと考えるのですが、戦争犯罪だと主張する方がいいのでしょうか?

 国連の1948年のジェノサイド防止・処罰条約第2条(1948 United Nations Convention on the Prevention and Punishment of the Crime of Genocide (CPPCG). Article 2)のジェノサイドの定義:
"any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: killing members of the group; causing serious bodily or mental harm to members of the group; deliberately inflicting on the group conditions of life, calculated to bring about its physical destruction in whole or in part; imposing measures intended to prevent births within the group; [and] forcibly transferring children of the group to another group."

に照らせば、日本への原爆投下等は、ジェノサイドと言えないこともないと言えます。
 しかし、法の一般原則である法の不遡及の原則に照らせば、これでもって1945年に犯された「犯罪」を処罰することはいかがなものでしょうか。

 ただ、1945〜46年に行われたニュルンベルグ裁判では、同裁判の規約第6条C項(The London Charter of the International Military Tribunal paragraph 6.c,)が、事後法ながら人道に対する罪(Crimes Against Humanity)(注)

 (注)"Murder, extermination, enslavement, deportation, and other inhumane acts committed against any civilian population, before or during the war, or persecutions on political, racial or religious grounds in execution of or in connection with any crime within the jurisdiction of the Tribunal, whether or not in violation of the domestic law of the country where perpetrated".

を規定しており、主要戦犯24人中この罪単独で起訴された者はいないけれど、この罪のみが有罪とされた者が2人います。(1人は死刑、もう一人は20年の刑)

 そこで、法のもう一つの一般原則である公平の原則に従い、先の大戦における連合国関係者も人道の罪で裁かれるべきである、とする議論はできるはずです。
 原爆投下等がこの人道に対する罪にあたることは間違いないのではないでしょうか。

 なお、1946〜48年の極東軍事裁判では「人道に対する罪」で起訴された者はいません。

 イスラエルの平均IQが、そのままユダヤ人のIQというのは論理が跳躍しすぎです。
 イスラエルにはアラブ人も住んでいるし、パレスチナ人も多く住んでいるからです。
 某博士は統計の素人で、もう少しサンプリングの方法について学ぶべきかも知れません。
 調査結果からは、全くその辺の事が考慮されていないと思われます。

 パレスティナ人はあくまでもアラブ人、より正確に言うと、その大部分がイスラム教スンニ派であるところのアラビア語のパレスティナ方言をしゃべるアラブ人です。

 また、私は、コラム#1465で、「(イスラム教徒も含まれていますが)イスラエル人は94でしかない」と、ちゃんと断っています。
 キミ、思いついてすぐ投稿するんじゃなく、コラムを読み返し、あやふやな知識はネットで確かめた上で投稿文を書くようにした方がいいよ。

 なお、イスラエル在住のアラブ人は総人口の20%(ウィキペディア上掲)であるところ、仮にイスラエルのユダヤ人の平均IQが韓国(106)や日本(105)を上回る、事実上世界一の107だとすると、イスラエル在住のアラブ人のIQは42という低さである、ということになっちゃいます。
 しかし、アラブ諸国のIQを見ると、イラク87、エジプト/サウディ/ア首連83、カタール78であり、

もともと教育程度が高いとされているパレスティナ人↓

が、中東で最も教育環境の整っているイスラエル(典拠省略)に住んでいるのですから、彼らがイラクを超えるIQを持ってても不思議はありません。
 そうである以上、パレスティナ人の存在は、イスラエル全体のIQをそう大きくは引き下げていないはずだ、よってイスラエルのユダヤ人のIQは韓国や日本よりはるかに低い、と見るべきでしょう。

 本日から、「エジプト「革命」」を「エジプト革命」と呼ぼう。
 同国の憲法規定が軍部によって一部無視されたからだ。↓

 河村たかし名古屋市長を民主党に引き留めておくことができなかったのは、菅首相の責任か岡田幹事長の責任か。↓

 先の大戦当時、米国は中南米を米国内扱い(OSSじゃなくFBIの管轄)していたことが良く分かる。
 また、米国(OSS)が・・諜報機関だから当たり前とも言えないことはないが・・戦時国際法など屁のカッパだったことも良く分かる。↓
