三井環氏がとって付けたような私憤から義憤への変節をみても、到底清廉潔白だとはおもっていないが、しかし、己の正義をうたう手段としての内部告発や国策捜査を発言していることは、我々の与り知らぬ検察内部事情の信憑性が逆に高いとおもっている。
現役官僚であればとても口外できぬこと（守秘義務があり）を、三井環氏のポジションであればこそ提供してくれるという”最後っ屁”？のようなものだな〜陳腐な表現だけど。
内部情報が漏れるのは、内部に軋轢があることが多い。氏にも当然、情報がくる。
この際だからこそ、小沢も検察も、途中で握り金玉なんぞせずに、徹底的にやり合い、互いの膿を出して欲しいとおもっているが、現実は互いに落としどころを探っているんだろーな。
なんせ、互いに権力を誇示する汚い悪党同士なので、白黒決着は難しいと推測する。

じゃあ逆に聞くけど、官庁が裏金作って当てるような「交際」で、交際費が経費と認められるケースって何よ？
人を恥知らず呼ばわりするからにはきちんと答えるべきだろうね＞太田。

これだけでは、日本国憲法に規範性がないという理由が自分にはわからないので、もう少し説明してもらえませんか？
＜太田＞
かつて最高裁が示した「目的効果基準」なる、まことにルーズな憲法第89条解釈の下、この条項は既にほとんど規範的意味を失っていました。
では、今回の「厳格な」最高裁判決によって、同条項は規範性を回復したのでしょうか。
いや、その逆です。
最高裁は、憲法第89条に違反するかどうかついて、「目的効果基準」から、「＜当該＞宗教・・・の性格や・・・経緯、一般人の認識などの諸般の事情を考慮し、総合的に判断すべきだ」とする基準へ、と今回、解釈変更（判例変更）を行ったわけですが、今度の基準は、一層、意味不明、と言うか無内容なものになってしまったからです。
今後、下級審はもとより、最高裁自身が新たな係争事案を裁く際に、いかなる判決を下すべきか、従来以上に苦慮することになる、と私は予想します。
たまたま今回の事案に関しては、同条項の文面に「厳格な」判決が下されたように見えるけれど、新たな事案に関し、同じような判決が下される保証は全くないと言って良いでしょう。
以上から、私は、今回の最高裁判決によって、憲法第89条の規範性は完全に失われたのであって、今後、この種事案は、実質的には、違憲訴訟と言うよりは、行政行為ないし公金の支出の違法性の有無を争う訴訟という技術的な性格のものになるだろう、と考える次第です。
ところで、憲法に規範性がムッチャある米国の最高裁で、ひどい時代錯誤的判例変更が行われました。
法人が政治にカネを使う権利が認められちゃいましたよ。↓
オバマ政権を含め、米民主党はこの判決に強く反発していますが、やっぱ、米国はファシズムに向かってるのかなあ。

随分昔のコラムですが、コラム#0088「個人主義（その１）（アングロサクソン論６）」↓に関連してなくもないです。
……「個人主義者」であるイギリス人にとっては、結婚は、熟慮の末に踏み切るべき事業といったものだったのですが、いったん結婚すると常に仲むつまじく一緒に行動するというのが、昔の大陸諸国からの訪問者にとっては、大変奇妙な習慣に写ったようです。まさに、個人主義社会に生きる、孤独なイギリス男性にとって、「妻は、若いときには情婦、中年では友人、老年では看護婦」（ベーコン『随想録』）であるのでしょう。（『結婚』）
このイギリスの「奇妙な習慣」が、やはり次第にヨーロッパのみならず、世界を席巻しつつあることは、ご承知のとおりです。
