ホントかね。
昨夜、『時計じかけのオレンジ』の映画ビデオを鑑賞した。
1962年の小説に基づく1971年の映画であり、粗暴犯の矯正がテーマだと割り切れば、今やちょっと陳腐だ。
だけど、様々な想念を掻き立てる映画ではある。
善意や悪意の知能犯の場合、矯正などいかなる意味でも不可能じゃないか、なんてね。

善意の知能犯の例だけど、最近じゃ、悪霊を除霊するため『滝行』を行い子供を窒息死させた事件があったね。スターリンやオウム信者が犯した殺人等も善意の知能犯によるものと言えるだろう。

中知的能力の高い者だ。（ホロコーストに関してヒットラーが善意の知能犯だったのか悪意の知能犯だったのかは微妙なところだ。）
ボクのイメージでは、上記以外に、犯罪でもって自分の利得を図ろうとするところの、単なる知能犯がいる。

いや、阿部教授が提示している解決策というのは、チョー雑駁に言うと、入札談合など種々様々な「違法行政を防止する」という観点から、「違法行為を犯した公務員に」対し「求償権の行使を」厳格化すべきだという主張であって、それ以上でもそれ以下でもないです。
（『自治研究 87(9)』2011/9 p8及びp30参照。）
防衛省(庁)のリスト事件は求償権の不行使というケース・スタディとして扱われているだけです。
詳細に触れられていますが、その問題について阿部教授が解決策と言えるようなモノを何か提示している訳ではないです。
